1. Applicability & Acceptance of These Terms of Use

The terms “you” or “user” refer to any person or entity that engages with our Services in any way.

2. User License

RemembrLink.com grants you a limited, personal, revocable, and non-transferable license to view and use the Services for your own non-commercial purposes. You may download, share through authorized social platforms or email, or print individual pages for personal use, provided you do not alter or remove any copyright, trademark, or other proprietary notices.

3. Services Content

Some features of the Services allow users to submit material (“Content”), such as obituaries, photos, or messages. You agree not to post Content that is offensive, unlawful, harmful, misleading, infringes on rights, promotes causes outside intended use, or contains harmful code.
b) Your Assurances
Each time you provide Content, you confirm that you own or have permission to share it and that it complies with these Terms.
c) License You Grant
By submitting Content, you grant RemembrLink.com a worldwide, royalty-free, perpetual license to use, reproduce, distribute, display, and create derivative works from it in any medium. This includes using your name in connection with the Content. RemembrLink.com does not claim ownership of your Content.
d) Our Responsibility
RemembrLink.com is not responsible for user-generated Content and does not guarantee its accuracy. We may remove or edit Content at any time.
e) Review & Removal
We may review or remove Content that violates these Terms or for any reason. Paid Content removed for non-violation reasons will be refunded. We comply with DMCA rules for copyright disputes.
f) Proprietary Rights
All materials, designs, text, graphics, and software on the Services belong to RemembrLink.com and may not be used without permission.
4. Termination and Modifications to the Services
RemembrLink.com may change, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We are not liable to you or others for these actions.
5. Indemnity
You agree to defend, indemnify, and hold harmless RemembrLink.com, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services, Content you submit, or any breach of these Terms.
6. Disclaimer of Warranties
The Services and all content are provided “as is” and “as available.” RemembrLink.com disclaims all warranties, express or implied, including but not limited to:

- Fitness for a particular purpose
- Non-infringement
- Freedom from viruses
We do not guarantee uninterrupted or error-free operation.
7. Limitation of Liability
a) General Limitation
RemembrLink.com is not liable for indirect, incidental, or consequential damages, including lost profits or data, even if advised of the possibility.
b) Liability Cap
Our total liability will not exceed the greater of the amount you paid us or $100.
c) Agreement on Fairness
You agree these limits are fair and reasonable.
d) Exclusive Remedy
If you are dissatisfied with the Services, your sole remedy is to stop using them.
8. Cancellation, Termination, Transfer, and Expiration
a) By You
You may cancel your account at any time with written notice. Termination is effective immediately.
b) By RemembrLink.com
We may suspend or terminate accounts at any time for reasons including inactivity, violations, or disputes.
c) Effect of Termination
You will lose access to Content submitted, which may be deleted. We are not responsible for loss of data.
d) Refunds
Payments are generally non-refundable unless stated otherwise.
e) Memorial Websites
- Creator/manager is the Site Host.
- Payer is the Site Sponsor.
- Site Host has first right to become Sponsor.
- Unsponsored sites may be archived.
- Hosts may appoint replacements.
- We may archive sites at our discretion.
f) Obituary Refunds
Refunds are issued if an obituary is canceled before publication deadlines. Obituaries cannot be canceled after deadlines.
9. Permanence of Material
Content marked “permanent” will remain as long as RemembrLink.com operates. “One-year” content remains for one year. These terms may not apply if the Services cease operations or due to events beyond our control. You may request removal at any time.
10. Minors
Users under 13 must have parental or guardian consent. Parents/guardians are responsible for a minor’s activities. Parental control tools are available to help restrict access to harmful content.
11. Your Account, Password, and Security
a) Registration
You must provide accurate, current information when creating an account. False information may result in suspension.
b) Responsibility
You are responsible for your account’s security and all activity under it. Notify us of unauthorized use and log out after each session.
c) Limitation
RemembrLink.com is not liable for losses due to your failure to protect your account.
12. Links and Framing
The Services may link to third-party websites. We do not control or endorse these sites and are not responsible for their content. Visiting them is at your own risk. You may not link or frame the Services in a misleading way without our written permission.
13. Trademarks
All trademarks and logos of RemembrLink.com may not be used without permission. Other trademarks appearing on the Services remain the property of their respective owners.
14. Consideration
By using the Services, you acknowledge that valuable consideration supports this agreement, including access to features, content, and visibility of your submissions.
15. Third-Party Software
The Services may include third-party software or tools. Your use of them is subject to the provider’s license terms. Rights remain with the provider, and you must agree to their terms before use.
16. Arbitration
a) Agreement to Arbitrate
Disputes will be resolved by binding arbitration instead of court. By accepting these Terms, both parties waive jury trial and class actions.
b) Exceptions
Claims may still be brought in small claims court, through government agencies, or for intellectual property issues.
c) Opt-Out
You may opt out within 30 days by written notice.
d) Rules
Arbitration follows Federal Arbitration Act and AAA Consumer Rules.
e) Notice
Before filing, parties must attempt resolution via written notice. If unresolved after 30 days, arbitration may proceed.
f) Fees
RemembrLink.com reimburses filing fees for claims under $300 unless frivolous.
g) No Class Actions
Claims must be individual only.
h) Changes
You may reject future changes within 30 days.
i) Enforceability
If this section is invalid, disputes will go to courts in Wyoming.
17. Jurisdiction, Applicable Law, and Limitations (Wyoming)
These Terms are governed by Wyoming law. If arbitration does not apply, disputes must be filed in state or federal courts in Wyoming. Claims must be filed within one year of the event, or they are barred.
18. General
a) Enforceability
Invalid provisions will be replaced with valid ones that match intent. Remaining Terms remain enforceable.
b) Entire Agreement
These Terms and our Privacy Policy form the complete agreement.
c) No Waiver
Failure to enforce a provision does not waive the right to enforce later. Neither party is responsible for events outside their control.
d) Headings
Headings are for convenience only.
e) Contact

19. SMS Services
By providing your phone number, you agree to receive text messages from RemembrLink.com. Carrier rates may apply. We may start, suspend, or stop SMS communications at any time. You may opt out by following provided instructions.
